Domicile Status Verification

The Risk

Since Jan 2026, the FMCSA has withheld millions in funding from states (including CA and NC) that failed to revoke "illegally issued" non-domiciled licenses. Drivers operating under these licenses can be pulled Out of Service immediately at any weigh station.

Your Action

Ask your carrier for a SAVE System Verification or proof of a "Social Security-linked" CDL. If the driver holds a non-domiciled license, verify they hold an active H-2A, H-2B, or E-2 visa. Do not accept loads assigned to drivers with unverified domicile status.

English Language Proficiency (ELP) Compliance

The Risk

Per the 2025 Executive Order, failure to converse in English with an officer now triggers an automatic Out-of-Service (OOS) order. This isn't a warning—it's an immediate hold on your cargo.

Your Action

Ensure your carrier conducts "Roadside Assessment Mock-ups." If a driver cannot explain their Bill of Lading (BOL) in English at your dock, they likely won't pass a weigh station. Test this at the point of pickup, not when it's too late.

USDOT-Only Identification

The Risk

As of October 2025, the transition to USDOT-only numbering is mandatory. Carriers still relying on legacy MC numbers for primary identification may be flagged during audits and roadside inspections.

Your Action

Check that the carrier's equipment and paperwork display an active USDOT number and that their MCS-150 "Biennial Update" is current within the last 24 months. Verify on the FMCSA SAFER system before load assignment.

Clearinghouse "Prohibited" Status Check

The Risk

Under 2026 rules, any driver in "Prohibited" status (due to drug/alcohol violations) has their CDL automatically downgraded by the state. These drivers are operating illegally—and your cargo is on their truck.

Your Action

Require your carriers to provide a timestamped "Clearinghouse Query" for the specific driver assigned to your load. Not a blanket company statement—a driver-specific, dated query result.

ELD & Medical Cert Digital Integration

The Risk

The DOT now requires electronic submission of medical certificates. If the DMV doesn't have the digital copy on file, the driver is technically unlicensed—even if they have a valid physical card.

Your Action

Verify the driver has a "Medical Long Form" physical copy on hand, even though submission is digital. This prevents delays during roadside data-sync issues between state DMV systems and the federal database.
